Court fixes Dec 10 as next date of hearing in

Baghpat (UP), Dec 3 (UNI) A local court here fixed December 10 and the next date of hearing in the Neelkanth Temple versus Jama Masjid Shamsi case in Badaun district of Uttar Pradesh on Tuesday, court sources said here.
Sources said that the counsels of the Muslim side prayed to dismiss this application during which they argued that the Hindu Mahasabha does not have the legal right to become the plaintiff.
Shamsi Shahi Jama Masjid Intezamia Committee/Waqf Board advocate Asrar Ahmed said that the mosque is about 850 years old and there is no existence of a temple there. He said that the Hindu Mahasabha does not have the right to file a petition in this matter.
He argued that worship had never been done in the mosque in the past and worship cannot be done in the mosque, so there is no justification for allowing worship. He argued that the Hindu Mahasabha does not have the legal right to become the plaintiff in this.
Shamsi Shahi Masjid Intezamia Committee advocate Asrar Ahmed said that there is no existence of a temple in the mosque. He said that Hindu Mahasabha has no right to file a petition in this matter.
He argued that there is no justification for allowing worship in the mosque. He says that filing such a petition in the court violates the Place of Worship Act. The debate in this case is not yet complete.
Counsel of the Hindu side Ved Prakash Sahu said that the intention of the advocates of the Muslim side is to prolong the case and they only waste our time as well as the court's time in the name of argument in the case.
The court directed the Muslim side to appear in the court on December 10 at 10:30 for the further arguments and it has also been instructed that the Muslim side will have to complete its debate on the same day, after which the advocate of the Hindu side will present its side before the court.
On the question of the Muslim side not being able to pursue the case, counsel Ved Prakash Sahu of the Hindu side said that we have sufficient evidence and we will present our claim by presenting evidence of the existence of a temple in the mosque and will also get permission from the court for worship.
The plaintiff on behalf of Neelkanth Mahadev Temple Mukesh Patel said that it was King Mahipal's fort and there was a temple which was demolished by the ruler of the slave dynasty invader Shamsuddin Altumish and converted into a mosque.
Mukesh Patel said that the court of Civil Judge Senior Division Amit Kumar has given the date of 10 December, in which the advocates of both the sides have to appear in the court at 10:30 and present their side.
