HC directs promotion of ASI exonerated in departmental enquiry

Shimla, Sep 9 (UNI) Himachal Pradesh High Court has held that a police officer, who was exonerated in a departmental inquiry despite being named in a narcotics-linked case, could not be denied promotion merely on the basis of a pending criminal case.
Justice Sandeep Sharma, in a nine-page verdict delivered on September 3 (shared with the media today), allowed the petition of Bir Singh, presently serving as an Honorary Head Constable, directing the State to promote him to the post of Honorary Assistant Sub-Inspector (ASI) with all consequential benefits from the due date.
The case dates back to 2011 when an FIR (No. 347 of 2011) under Sections 409 and 120-B IPC was registered at Police Station Kullu against eight policemen, including Bir Singh, for alleged tampering with locks kept in the malkhana in connection with a massive narcotics seizure.
