Nvidia raises concern over GAIN AI Act, counters the legislation as anti-competitive

New Delhi, Sep 6 (UNI) Leading AI chipmaker Nvidia has raised strong concern over the GAIN AI Act, warning that the proposed law would restrict global competition for advanced processors and hurt industries worldwide that depend on cutting-edge computing power.
The Guaranteeing Access and Innovation for National Artificial Intelligence Act (GAIN) AI Act, recently introduced seeks to ensure that American buyers, including startups, universities, and small businesses, get priority access to advanced AI chips before they are exported overseas.
The legislation also proposes licensing requirements for shipments of high-performance chips above a certain processing threshold, effectively tightening controls on who gets access to the world’s most powerful AI hardware.
Nvidia, which dominates the market for AI chips, pushed back firmly against the proposal. An official spokesperson today said, “We never deprive American customers in order to serve the rest of the world. In trying to solve a problem that doesn’t exist, the proposed bill would restrict competition worldwide in any industry that uses mainstream computing chips.”
However, this Act has found strong backing from Americans for Responsible Innovation (ARI), a think tank founded by former Congressman Brad Carson and tech entrepreneur Eric Gastfriend.
Defending the proposal, ARI President Brad Carson said, “Advanced AI chips are the jet engine that’s going to enable the U.S. AI industry to lead for the next decade. Globally, these chips are currently supply-constrained, which means that every advanced chip sold abroad is a chip the U.S. can’t use to accelerate American R&D. As we compete to lead on this dual-use technology, including the GAIN AI Act in the NDAA would be a major win for U.S. competitiveness and national security.”
The debate underscores the growing tension between economic competition and national security. On one side, Nvidia and other chipmakers fear restrictions will erode U.S. leadership by cutting them off from lucrative overseas markets.
On the other hand, lawmakers and policy groups insist that limiting exports is the only way to guarantee that America has the tools it needs to maintain its edge in AI research and defense applications.
The National Defence Authorisation Act (NDAA) is a US federal law that sets policy and budget for a specific policy year. It authorises appropriations for the Department of Defense (DOD), nuclear weapons programs of the Department of Energy, and other defence related activities.
