SC clarifies OBC quota directions in Maha local body polls; says 50pc reservation cap cannot be breached

New Delhi, Nov 17 (UNI) The Supreme Court today clarified that its earlier directions on reservation for Other Backwards Classes (OBCs) in Maharashtra’s local body elections have been misinterpreted and reiterated that the 50% cap on total reservations cannot be crossed for the upcoming polls scheduled on January 31, 2026.
A Bench comprising Justice Surya Kant and Justice Joymalya Bagchi made the observation while hearing pleas challenging the State’s move to implement a fresh OBC reservation matrix based on the Banthia Commission’s report.
The dispute traces back to the Constitution Bench ruling in Vikas Kishanrao Gawali v. State of Maharashtra, which struck down the earlier 27% OBC quota and introduced the “triple test” for OBC reservation in local bodies.
