SC grants anticipatory bail to YouTuber in case over remarks against politician

New Delhi, June 18 (UNI) The Supreme Court on Wednesday granted anticipatory bail to journalist and YouTuber Nandakumar T.P., popularly known as 'Crime Nandakumar', in connection with a case registered over alleged objectionable remarks made against former SFI leader and CPI(M) member Sindhu Joy.
A vacation bench comprising Justices Sandeep Mehta and Prasanna B. Varale granted interim relief to Nandakumar, directing that in the event of his arrest, he shall be enlarged on bail by the jurisdictional trial court upon furnishing bail bonds to the satisfaction of the investigating officer. The court further directed the petitioner to cooperate with the investigation.
A bench passed the order while hearing a special leave petition filed by Nandakumar challenging the Kerala High Court’s refusal to grant him anticipatory bail.
The FIR against Nandakumar was registered after he uploaded a video allegedly targeting a prominent woman politician. The prosecution claimed that the video contained derogatory, sexually coloured, and threatening remarks aimed at insulting the victim’s modesty and harming her reputation.
He has been booked under Sections 75(1)(iv) (insulting the modesty of a woman), 79 (intimidation with intent to harm reputation), and 351(1)(2) (electronic dissemination of obscene content) of the Bharatiya Nyaya Sanhita, 2023, along with Section 67 of the Information Technology Act, 2000, which penalizes the publishing or transmission of obscene material in electronic form.
Earlier, the Kerala High Court had declined to grant him anticipatory bail, directing him to first surrender before the police through an order dated June 9, 2025.
Challenging this order, Nandakumar approached the Supreme Court.
The matter will be listed for further hearing after six weeks.
